Terms of Service

These Terms of Service set out the rules for using the SmartTranslate.ai service (the "Service") by individuals and businesses. The Terms apply to both publicly available features (e.g. informational pages, waitlist) and features that require an account (if available).

1. General provisions and acceptance of the Terms

  • By using the Service, you enter into an agreement with the Operator for the provision of electronic services and accept these Terms.
  • If you do not accept the Terms, do not use the Service.
  • If you use the Service on behalf of a company/organisation, you represent that you have the authority to act on its behalf and to bind it to these Terms.
  • The Operator may provide the Service in a trial (beta) version, with limited features and availability.

2. Definitions (brief)

  • "Operator" - the entity operating the SmartTranslate.ai Service.
  • "User" - a person using the Service.
  • "Account" - a User account on the Service, if registration/login functionality is provided.
  • "Content" - data entered or uploaded by the User to the Service, including text and documents for translation as well as translation settings/profile.
  • "Pricing" / "Plan" - information about available usage options, limits and fees published in the Service (e.g. on the pricing page).

3. Service description and scope

  • The Service enables translation of content and (depending on the Plan) documents using artificial intelligence models and translation profile settings (e.g. industry, style, tone, formality).
  • AI-generated outputs may contain errors, omissions, inaccuracies or inappropriate wording and may require human verification.
  • The Service does not constitute certified/sworn translation or legal, medical, financial or other specialised advice.
  • The Operator may introduce, modify or withdraw Service features (including plans, limits, supported formats) subject to the changes provisions set out in the section on amendments to the Terms.

4. Account, login and security

  • Account creation and login may be facilitated using an external authentication provider (Clerk).
  • Login access may be temporarily restricted (e.g. to a selected group of users).
  • The User is responsible for the confidentiality of login credentials and for activities performed through their Account.
  • If unauthorised access to the Account is suspected, the User should promptly notify the Operator.

5. User Content and rights

  • The User retains rights to their Content. The Operator does not acquire ownership rights to User Content.
  • The User grants the Operator a non-exclusive licence necessary to provide the service, including processing, analysing, transforming, translating, temporary storage and making results available to the User (e.g. translated file).
  • The User represents that they have the rights and legal basis to submit Content to the Service (including personal data of third parties, if present in the Content) and that the Content does not violate laws or third-party rights.
  • The User is responsible for how translation results are used and for ensuring their compliance with law and industry requirements.

6. Permitted use and prohibitions

  • The Service may only be used in compliance with the law and with respect for third-party rights.
  • It is prohibited to upload illegal Content, or Content that infringes copyrights, personal rights, legally protected secrets or other third-party rights.
  • It is prohibited to use the Service to create or distribute harmful content (e.g. malware, phishing), or to circumvent the Service's security measures.
  • Excessive, automated or disruptive use of the Service in a way that may affect its stability (e.g. scripts, bots) is prohibited without the Operator's prior consent.
  • The Operator may employ security and abuse mitigation mechanisms (e.g. limits, rate-limiting) and may suspend access in case of violations.

7. Plans, limits, fees and billing (if applicable)

  • The Service may offer different Plans (including free and paid) with varying limits (e.g. character limits per period, supported file formats, storage period for translation history).
  • The current description of Plans and pricing is available on the Pricing page in the Service. In case of discrepancies between the Pricing and promotional materials, the Pricing and these Terms shall prevail.
  • The Operator may introduce payments, subscriptions, invoicing or billing for business/Enterprise plans. Details (including taxes, invoices, cancellation terms) will be communicated in the Service or during the purchase process.
  • If the laws applicable to the User provide specific consumer rights (e.g. right of withdrawal), the Operator will respect them to the extent required by law.

8. Privacy and data

  • We describe personal data processing in the Privacy Policy, and cookie practices in the Cookies Policy (available in the Service).
  • By using the Service, you acknowledge that Content may contain personal or confidential data - before uploading, ensure you have the right and legal basis to do so.
  • The Operator may use technical data (e.g. IP address, user-agent) for security and abuse prevention in accordance with the Privacy Policy.

9. Service availability and support

  • The Operator endeavours to keep the Service functioning properly but does not guarantee uninterrupted availability or error-free operation.
  • The Operator may perform maintenance, updates and technical outages.
  • The level of technical support may depend on the Plan. General inquiries: privacy@smarttranslate.ai.

10. Liability and disclaimers

  • To the fullest extent permitted by law, the Operator is not liable for decisions made based on results obtained from the Service or for indirect damages (e.g. lost profits), unless mandatory law provides otherwise.
  • The User is responsible for verifying results, particularly in legal, medical, financial, safety or other critical applications.
  • The Operator does not warrant that results will be error-free or meet all of the User's expectations.

11. Consumers (EU) - right of withdrawal and complaints (if applicable)

  • If you are a consumer in the EU/EEA, you may have specific rights under consumer laws and laws on digital services and content.
  • For digital services, if you consent to the commencement of performance before the withdrawal period expires and are informed of the consequences, you may lose the right of withdrawal in respect of the service already performed, in accordance with law.
  • Complaints or reports regarding the Service may be sent to: privacy@smarttranslate.ai (describe the issue and provide contact details).

12. Suspension and termination of use

  • The Operator may suspend or restrict access to the Service if the User breaches the Terms, the law or the security of the Service, or if abuse is suspected.
  • The User may stop using the Service at any time. If an account deletion feature is available, the User may use it or contact the Operator.

13. Changes to the Terms

  • The Operator may change the Terms for valid reasons, such as changes in law, security, Service functionality, providers or billing practices.
  • The current version of the Terms is published in the Service with the date of the last update. Material changes affecting Accounts or paid plans (if available) will be communicated appropriately.

14. Governing law and final provisions

  • These Terms are governed by the law applicable to the Operator's registered office, subject to mandatory consumer protection provisions.
  • Disputes will be resolved by courts competent for the Operator's registered office, unless mandatory law provides otherwise.
  • If any provision of the Terms is held invalid, the remaining provisions remain in force.
