Terms of Service

These Terms of Service set out the rules for using the SmartTranslate.ai service (the "Service") by private individuals and business entities. These Terms apply both to publicly available features (e.g. the information page, waitlist) and to features that require an account (if available).

1. General provisions and acceptance of the Terms

  • By using the Service, you enter into an agreement with the Administrator for the provision of electronic services and accept these Terms.
  • If you do not accept the Terms, do not use the Service.
  • If you use the Service on behalf of a company/organisation, you confirm that you are authorised to act on its behalf and to bind it to these Terms.
  • The Administrator may provide the Service in a test (beta) version, with limitations on features and availability.

2. Definitions (summary)

  • "Administrator" - the entity operating the SmartTranslate.ai Service.
  • "User" - a person using the Service.
  • "Account" - the User's account in the Service, if registration/login functionality is made available.
  • "Content" - data entered or uploaded by the User to the Service, including text and documents for translation as well as translation settings/profile.
  • "Pricing" / "Plan" - information about the available ways to use the Service, limits and fees, published in the Service (e.g. on the pricing page).

3. Description and scope of the service

  • The Service enables the translation of content and, depending on the Plan, documents using artificial intelligence models and translation profile settings (e.g. industry, style, tone, formality).
  • AI-generated results may contain errors, omissions, inaccuracies or inappropriate wording and may require human review.
  • The Service is not a sworn/certified translation service or legal, medical, financial or other specialist advice.
  • The Administrator may introduce, modify or withdraw Service features (including plans, limits and supported formats) in accordance with the rules described in the section on changes to the Terms.

4. Account, login and security

  • Account creation and login may be carried out using an external authentication provider (Clerk).
  • Access to login may be temporarily restricted (e.g. only for a selected group of users).
  • The User is responsible for keeping login details confidential and for actions performed within their Account.
  • If unauthorised access to the Account is suspected, the User should notify the Administrator without delay.

5. User Content and rights

  • The User retains all rights to their Content. The Administrator does not acquire ownership rights to the User's Content.
  • The User grants the Administrator a non-exclusive licence necessary to provide the service, including processing, analysis, transformation, translation, technical storage and making the results available to the User (e.g. the translated file).
  • The User confirms that they have the rights and grounds to submit the Content to the Service (including any personal data of third parties, if present in the Content) and that the Content does not infringe any law or the rights of third parties.
  • The User is responsible for how the translation results are used and for ensuring they comply with the law and industry requirements.

6. Permitted use and prohibited conduct

  • The Service may be used only in accordance with the law and with respect for the rights of third parties.
  • It is prohibited to submit Content that is illegal, infringes copyright, personal rights, legally protected confidential information or other rights of third parties.
  • It is prohibited to use the Service to create or distribute harmful content (e.g. malware, phishing) or to bypass the Service's security measures.
  • It is prohibited to use the Service excessively, automatically or in a disruptive manner in a way that may affect its stability (e.g. scripts, bots) without the Administrator's prior consent.
  • The Administrator may use security and abuse-prevention mechanisms (e.g. limits, rate limiting) and may suspend access in the event of violations.

7. Plans, limits, fees and billing (if applicable)

  • The Service may offer different Plans (including free and paid ones) with different limits (e.g. character limits per period, available file formats, retention period for translation history).
  • The current description of Plans and prices is available in the Pricing section of the Service. In the event of any discrepancy between the Pricing and promotional materials, the Pricing and these Terms shall prevail.
  • The Administrator may introduce payments, subscriptions, invoicing or settlement for business/Enterprise plans. Details (including taxes, invoices and cancellation terms) will be communicated in the Service or during the purchase process.
  • If the law applicable to the User provides special consumer rights (e.g. a right of withdrawal), the Administrator will respect them to the extent required by law.

8. Privacy and data

  • The rules for processing personal data are described in the Privacy Policy, and the rules for cookies are described in the Cookie Policy (both available in the Service).
  • By using the Service, you acknowledge that Content may contain personal or confidential data - before submitting it, make sure that you have the right and legal basis to do so.
  • The Administrator may use technical data (e.g. IP address, user agent) for security and abuse prevention purposes, in accordance with the Privacy Policy.

9. Service availability and support

  • The Administrator makes efforts to ensure that the Service works properly, but does not guarantee uninterrupted availability or the absence of errors.
  • The Administrator may carry out maintenance work, updates and technical interruptions.
  • The scope of technical support may depend on the Plan. General enquiries: privacy@smarttranslate.ai.

10. Liability and exclusions

  • To the fullest extent permitted by law, the Administrator is not liable for decisions made on the basis of results obtained from the Service or for indirect damages (e.g. loss of profits), unless mandatory law provides otherwise.
  • The User is responsible for verifying the results, especially in legal, medical, financial, security or other critical uses.
  • The Administrator does not guarantee that the results will be free from errors or that they will meet all of the User's expectations.

11. Consumers (EU) - right of withdrawal and complaints (if applicable)

  • If you are a consumer in the EU/EEA, you may have special rights under consumer law and the rules on digital services and digital content.
  • In the case of digital services, if you consent to the service beginning before the withdrawal period expires and you are informed of the consequences, you may lose the right of withdrawal in relation to the service already performed - in accordance with the law.
  • You may send complaints or reports concerning the Service to: privacy@smarttranslate.ai (describe the issue and provide contact details).

12. Suspension and termination of use

  • The Administrator may suspend or restrict access to the Service if the User breaches the Terms, the law or the Service's security, as well as in the event of suspected abuse.
  • The User may stop using the Service at any time. If the account deletion feature is available, the User may use it or contact the Administrator.

13. Changes to the Terms

  • The Administrator may change the Terms for important reasons, such as changes in law, security, Service functionality, providers or billing rules.
  • The current version of the Terms is published in the Service together with the date of the last update. Significant changes affecting Accounts or paid plans (if available) will be communicated appropriately.

14. Governing law and final provisions

  • These Terms are governed by the law applicable to the Administrator's registered office, subject to mandatory consumer protection provisions.
  • Disputes will be resolved by the courts competent for the Administrator's registered office, unless mandatory provisions provide otherwise.
  • If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
