Terms of Service

These Terms of Service set out the rules for using SmartTranslate.ai ("Service") by private individuals and business entities. These Terms apply both to publicly available features (e.g. the informational page, waitlist) and to features that require an account (if available).
1. General provisions and acceptance of the Terms
- By using the Service, you enter into an electronic services agreement with the Administrator and accept these Terms.
- If you do not accept these Terms, do not use the Service.
- If you use the Service on behalf of a company/organisation, you represent that you are authorised to act on its behalf and to bind it to these Terms.
- The Administrator may provide the Service in a test (beta) version, with limited features and availability.
2. Definitions (summary)
- "Administrator" - the entity operating the SmartTranslate.ai Service.
- "User" - a person using the Service.
- "Account" - the User's account in the Service, if registration/login is made available.
- "Content" - data entered or submitted by the User to the Service, including text and documents for translation as well as translation settings/profile.
- "Pricing" / "Plan" - information about the available ways to use the Service, limits and fees, published in the Service (e.g. on the pricing page).
3. Description and scope of the service
- The Service allows you to translate content and, depending on the Plan, documents using artificial intelligence models and translation profile settings (e.g. industry, style, tone, formality).
- AI-generated results may contain errors, omissions, inaccuracies or unsuitable wording and may require human review.
- The Service is not a sworn translation service or legal, medical, financial or other professional advice.
- The Administrator may introduce, modify or withdraw Service features (including plans, limits and supported formats) in accordance with the rules described in the section on changes to the Terms.
4. Account, login and security
- Account creation and login may be handled using a third-party authentication provider (Clerk).
- Access to login may be temporarily restricted (e.g. to a selected group of users only).
- The User is responsible for keeping login credentials confidential and for actions carried out through their Account.
- If unauthorised access to the Account is suspected, the User should notify the Administrator immediately.
5. User Content and rights
- The User retains rights to their Content. The Administrator does not acquire ownership rights to the User's Content.
- The User grants the Administrator a non-exclusive licence necessary to provide the service, covering processing, analysis, transformation, translation, technical storage and making results available to the User (e.g. the translated file).
- The User represents that they have the rights and grounds to submit the Content to the Service (including personal data of third parties, if present in the Content) and that the Content does not infringe any law or the rights of third parties.
- The User is responsible for how the translation results are used and for ensuring they comply with the law and industry requirements.
6. Permitted use and prohibitions
- The Service may only be used in accordance with the law and with respect for the rights of third parties.
- It is prohibited to submit unlawful Content that infringes copyright, personal rights, legally protected secrets or other rights of third parties.
- It is prohibited to use the Service to create or distribute harmful content (e.g. malware, phishing), as well as to bypass the Service's security measures.
- It is prohibited to use the Service excessively, automatically or disruptively in a way that may affect its stability (e.g. scripts, bots) without the Administrator's prior consent.
- The Administrator may use security and anti-abuse mechanisms (e.g. limits, rate limiting) and may suspend access in the event of violations.
7. Plans, limits, fees and billing (where applicable)
- The Service may offer different Plans (including free and paid) with different limits (e.g. character limits over a period, available file formats, translation history retention period).
- The current description of Plans and prices is available in the Pricing section in the Service. If there is any discrepancy between the Pricing and promotional materials, the Pricing and these Terms prevail.
- The Administrator may introduce payments, subscriptions, invoicing or billing for business/Enterprise plans. Details (including taxes, invoices and cancellation terms) will be communicated in the Service or during the purchase process.
- If the laws applicable to the User provide for specific consumer rights (e.g. the right to cancel), the Administrator will respect them to the extent required by law.
8. Privacy and data
- We describe the rules for processing personal data in the Privacy Policy, and cookie rules in the Cookie Policy (available in the Service).
- By using the Service, you acknowledge that Content may contain personal or confidential data - before submitting it, make sure that you have the right and legal basis to do so.
- The Administrator may use technical data (e.g. IP address, user agent) for security and abuse prevention purposes, in accordance with the Privacy Policy.
9. Service availability and support
- The Administrator makes reasonable efforts to ensure the Service works properly, but does not guarantee uninterrupted availability or error-free operation.
- The Administrator may carry out maintenance, updates and technical outages.
- The scope of technical support may depend on the Plan. General enquiries: privacy@smarttranslate.ai.
10. Liability and disclaimers
- To the fullest extent permitted by law, the Administrator is not liable for decisions made based on results obtained from the Service or for indirect damages (e.g. loss of profits), unless mandatory law provides otherwise.
- The User is responsible for verifying the results, especially in legal, medical, financial, safety or other critical use cases.
- The Administrator does not guarantee that the results will be free from errors or that they will meet all of the User's expectations.
11. Consumers (EU) - cancellation rights and complaints (where applicable)
- If you are a consumer in the EU/EEA, you may have specific rights under consumer and digital services/content laws.
- For digital services, if you consent to the service starting before the cancellation period ends and are informed of the consequences, you may lose the right to cancel for the part of the service already performed - in accordance with the law.
- You may send complaints or reports about the Service to: privacy@smarttranslate.ai (describe the issue and provide your contact details).
12. Suspension and termination of use
- The Administrator may suspend or restrict access to the Service if the User breaches the Terms, the law or the Service's security, or in the event of suspected abuse.
- The User may stop using the Service at any time. If an Account deletion feature is available, the User may use it or contact the Administrator.
13. Changes to the Terms
- The Administrator may change the Terms for important reasons, such as changes in the law, security, Service functionality, providers or billing rules.
- The current version of the Terms is published in the Service together with the last updated date. Significant changes affecting Accounts or paid plans (if available) will be communicated appropriately.
14. Governing law and final provisions
- These Terms are governed by the law applicable to the Administrator's registered office, subject to mandatory consumer protection laws.
- Disputes will be settled by the courts having jurisdiction over the Administrator's registered office, unless mandatory law provides otherwise.
- If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
