Terms of Service

These Terms of Service set out the rules for using SmartTranslate.ai (the "Service") by individuals and business entities. These Terms apply both to publicly available features (e.g. the information page, waiting list) and to features that require an account (if available).

1. General provisions and acceptance of the Terms

  • By using the Service, you enter into an agreement with the Administrator for the provision of electronic services and accept these Terms.
  • If you do not accept these Terms, do not use the Service.
  • If you use the Service on behalf of a company/organisation, you declare that you are authorised to act on its behalf and to bind it to these Terms.
  • The Administrator may make the Service available in a test version (beta), with limitations on features and availability.

2. Definitions (short form)

  • "Administrator" - the entity operating the SmartTranslate.ai Service.
  • "User" - a person using the Service.
  • "Account" - the User's account in the Service, if registration/login functionality is provided.
  • "Content" - data entered or uploaded by the User into the Service, including text and documents for translation, as well as translation profile/settings.
  • "Pricing" / "Plan" - information about the available ways to use the Service, limits and fees, published in the Service (e.g. on the pricing page).

3. Service description and scope

  • The Service enables translation of content and, depending on the Plan, documents using artificial intelligence models and translation profile settings (e.g. industry, style, tone, formality).
  • AI-generated results may contain errors, omissions, inaccuracies or inappropriate wording and may require human review.
  • The Service is not a certified translation service and does not provide legal, medical, financial or other specialised advice.
  • The Administrator may introduce, modify or withdraw Service features (including plans, limits and supported formats) while observing the rules described in the section on changes to the Terms.

4. Account, sign-in and security

  • Account creation and sign-in may be handled using an external authentication provider (Clerk).
  • Access to sign-in may be temporarily restricted (e.g. to a selected group of users only).
  • The User is responsible for the confidentiality of login details and for actions carried out through their Account.
  • If unauthorised access to the Account is suspected, the User should notify the Administrator immediately.

5. User Content and rights

  • The User retains rights to their Content. The Administrator does not acquire ownership rights to the User's Content.
  • The User grants the Administrator a non-exclusive licence necessary to provide the service, including processing, analysis, transformation, translation, technical storage and making results available to the User (e.g. the translated file).
  • The User declares that they have the rights and grounds to submit the Content to the Service (including personal data of third parties, if such data appears in the Content) and that the Content does not infringe the law or the rights of third parties.
  • The User is responsible for how the translation results are used and for ensuring their compliance with the law and industry requirements.

6. Permitted use and prohibited conduct

  • The Service may be used only in accordance with the law and with respect for the rights of third parties.
  • It is prohibited to submit unlawful Content that infringes copyright, personal rights, legally protected confidential information or other rights of third parties.
  • It is prohibited to use the Service to create or distribute harmful content (e.g. malware, phishing), as well as to bypass the Service's security measures.
  • It is prohibited to use the Service excessively, automatically or in a disruptive way that may affect its stability (e.g. scripts, bots) without the Administrator's prior consent.
  • The Administrator may use security and abuse-prevention mechanisms (e.g. limits, rate limiting) and may suspend access in the event of violations.

7. Plans, limits, fees and billing (if applicable)

  • The Service may offer different Plans (including free and paid ones) with different limits (e.g. character limit per period, available file formats, history retention period for translations).
  • The current description of the Plans and prices is available in the Pricing section in the Service. If there is any discrepancy between the Pricing section and promotional materials, the Pricing section and these Terms prevail.
  • The Administrator may introduce payments, subscriptions, invoicing or billing for business/Enterprise plans. Details (including taxes, invoices and cancellation terms) will be communicated in the Service or during the purchase process.
  • If the law applicable to the User provides special consumer rights (e.g. a right of withdrawal), the Administrator respects them to the extent required by law.

8. Privacy and data

  • The rules for processing personal data are described in the Privacy Policy, and the rules for cookies are described in the Cookie Policy (available in the Service).
  • By using the Service, you acknowledge that Content may include personal or confidential data - before submitting it, make sure you have the right and legal basis to do so.
  • The Administrator may use technical data (e.g. IP address, user-agent) for security and abuse prevention purposes, in accordance with the Privacy Policy.

9. Service availability and support

  • The Administrator makes reasonable efforts to ensure the Service works properly, but does not guarantee uninterrupted availability or error-free operation.
  • The Administrator may carry out maintenance work, updates and technical downtime.
  • The scope of technical support may depend on the Plan. General enquiries: privacy@smarttranslate.ai.

10. Liability and disclaimers

  • To the fullest extent permitted by law, the Administrator is not liable for decisions made on the basis of results obtained from the Service or for indirect damages (e.g. loss of profit), unless mandatory provisions of law provide otherwise.
  • The User is responsible for reviewing the results, especially in legal, medical, financial, security or other critical uses.
  • The Administrator does not guarantee that the results will be free from errors or that they will meet all of the User's expectations.

11. Consumers (EU) - right of withdrawal and complaints (if applicable)

  • If you are a consumer in the EU/EEA, you may be entitled to special rights under consumer protection rules and rules on digital services and digital content.
  • For digital services, if you consent to the service starting before the withdrawal period expires and you are informed of the consequences, you may lose the right of withdrawal for the part of the service already performed - in accordance with the law.
  • Complaints or reports concerning the Service may be sent to: privacy@smarttranslate.ai (describe the issue and provide contact details).

12. Suspension and termination of use

  • The Administrator may suspend or restrict access to the Service if the User violates the Terms, the law or the security of the Service, as well as in the event of suspected abuse.
  • The User may stop using the Service at any time. If the account deletion function is available, the User may use it or contact the Administrator.

13. Changes to the Terms

  • The Administrator may change the Terms for important reasons, such as changes in the law, security, Service functionality, providers or billing rules.
  • The current version of the Terms is published in the Service together with the date of the last update. Material changes concerning Accounts or paid plans (if available) will be communicated appropriately.

14. Governing law and final provisions

  • These Terms are governed by the law applicable at the Administrator's registered office, subject to mandatory consumer protection provisions.
  • Disputes shall be resolved by the courts competent for the Administrator's registered office, unless mandatory provisions of law provide otherwise.
  • If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
