Terms of Service

These Terms of Service set out the rules for using the SmartTranslate.ai service ("Service") by private individuals and business entities. These Terms apply both to publicly available features (e.g. the information page, waiting list) and to features that require an account (if available).

1. General provisions and acceptance of the Terms

  • By using the Service, you enter into an agreement with the Controller for the provision of electronic services and accept these Terms.
  • If you do not accept the Terms, do not use the Service.
  • If you use the Service on behalf of a company or organisation, you declare that you are authorised to act on its behalf and to bind it to these Terms.
  • The Controller may provide the Service in a beta version, with limited functionality and availability.

2. Definitions (summary)

  • "Controller" - the entity operating the SmartTranslate.ai Service.
  • "User" - a person using the Service.
  • "Account" - the User's account in the Service, if registration/login functionality is provided.
  • "Content" - data entered or sent by the User to the Service, including text and documents for translation, as well as translation settings/profile.
  • "Pricing" / "Plan" - information about the available ways to use the Service, limits and fees, published in the Service (e.g. on the pricing page).

3. Service description and scope

  • The Service allows you to translate content and, depending on the Plan, documents using artificial intelligence models and translation profile settings (e.g. industry, style, tone, formality).
  • AI-generated results may contain errors, omissions, inaccuracies or inappropriate wording and may require human review.
  • The Service is not a sworn translation service or legal, medical, financial or other professional advice.
  • The Controller may add, modify or withdraw Service features (including plans, limits and supported formats) in line with the rules described in the section on changes to the Terms.

4. Account, login and security

  • Account creation and login may be carried out using an external authentication provider (Clerk).
  • Access to login may be temporarily restricted (e.g. to a selected group of users only).
  • The User is responsible for keeping login details confidential and for actions carried out through their Account.
  • If unauthorised access to the Account is suspected, the User should notify the Controller without delay.

5. User Content and rights

  • The User retains the rights to their Content. The Controller does not acquire ownership rights to the User's Content.
  • The User grants the Controller a non-exclusive licence necessary to provide the service, including processing, analysis, transformation, translation, technical storage and making the results available to the User (e.g. the translated file).
  • The User declares that they have the rights and grounds to provide the Content to the Service (including personal data of third parties, if present in the Content) and that the Content does not infringe the law or the rights of third parties.
  • The User is responsible for how the translation results are used and for ensuring they comply with the law and industry requirements.

6. Permitted use and prohibited conduct

  • The Service may only be used in accordance with the law and with respect for the rights of third parties.
  • It is forbidden to submit illegal Content that infringes copyright, personal rights, legally protected secrets or other rights of third parties.
  • It is forbidden to use the Service to create or distribute harmful content (e.g. malware, phishing), or to bypass the Service's security protections.
  • It is forbidden to use the Service excessively, automatically or in a disruptive way that may affect its stability (e.g. scripts, bots) without the Controller's prior consent.
  • The Controller may use security and abuse-prevention measures (e.g. limits, rate limiting) and may suspend access in the event of violations.

7. Plans, limits, fees and billing (if applicable)

  • The Service may offer different Plans (including free and paid ones) with different limits (e.g. character limits per period, available file formats, retention period for translation history).
  • The current description of the Plans and prices is available in the Pricing section of the Service. If there is any discrepancy between the Pricing and promotional materials, the Pricing and these Terms prevail.
  • The Controller may introduce payments, subscriptions, invoicing or billing for business/Enterprise plans. Details (including taxes, invoices and cancellation terms) will be communicated in the Service or during the purchase process.
  • If the laws applicable to the User provide specific consumer rights (e.g. a right of withdrawal), the Controller will respect them to the extent required by law.

8. Privacy and data

  • The rules for processing personal data are described in the Privacy Policy, and the rules for cookies are described in the Cookies Policy (available in the Service).
  • By using the Service, you acknowledge that Content may contain personal or confidential data - before sending it, make sure you have the right and legal basis to do so.
  • The Controller may use technical data (e.g. IP address, user agent) for security and abuse prevention, in accordance with the Privacy Policy.

9. Service availability and support

  • The Controller makes every effort to keep the Service working properly, but does not guarantee uninterrupted availability or the absence of errors.
  • The Controller may carry out maintenance work, updates and technical interruptions.
  • The scope of technical support may depend on the Plan. General contact: privacy@smarttranslate.ai.

10. Liability and disclaimers

  • To the fullest extent permitted by law, the Controller is not liable for decisions made on the basis of results obtained from the Service or for indirect damages (e.g. loss of profits), unless mandatory law provides otherwise.
  • The User is responsible for verifying the results, especially in legal, medical, financial, security or other critical uses.
  • The Controller does not guarantee that the results will be free from errors or that they will meet all of the User's expectations.

11. Consumers (EU) - right of withdrawal and complaints (if applicable)

  • If you are a consumer in the EU/EEA, you may have specific rights under consumer rights laws and laws on digital services and digital content.
  • For digital services, if you consent to performance beginning before the withdrawal period expires and you are informed of the consequences, you may lose your right of withdrawal for the service already provided - in accordance with the law.
  • Complaints or reports concerning the Service may be sent to: privacy@smarttranslate.ai (describe the issue and include contact details).

12. Suspension and termination of use

  • The Controller may suspend or restrict access to the Service if the User breaches the Terms, the law or the security of the Service, or where abuse is suspected.
  • The User may stop using the Service at any time. If the account deletion function is available, the User may use it or contact the Controller.

13. Changes to the Terms

  • The Controller may change the Terms for important reasons, such as changes in the law, security, Service functionality, providers or billing rules.
  • The current version of the Terms is published in the Service together with the last updated date. Significant changes relating to Accounts or paid plans (if available) will be communicated appropriately.

14. Governing law and final provisions

  • These Terms are governed by the law applicable at the Controller's registered office, subject to mandatory consumer protection provisions.
  • Disputes will be resolved by the courts having jurisdiction over the Controller's registered office, unless mandatory law provides otherwise.
  • If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
